AstraZeneca will have no obligation whatsoever with respect to such information and will be free to use, disclose, reproduce, or publish such information without limitation, including for commercial purposes, without payment of any fees to users.
Civil liability
Unless prohibited by law, and except for any warranties expressly provided under these Terms of Use, any conditions, warranties, safeguards, rights or liabilities which would otherwise be implied into these Terms of Use or imposed by law are hereby excluded.
You use this Program at your own risk and AstraZeneca will not, under any circumstances, be liable for any damages (including, but not limited to, direct, incidental, consequential, indirect or punitive losses or damages arising from lost profits, lost data or business interruption) as a result of your access to, use of, or inability to access or use the website, or any errors or omissions in its content.
It is not an invitation to do business
Nothing stated in this Program represents an invitation to offer, invest in, or do business with AstraZeneca. In particular, actual results and developments may materially differ from any forecasts, opinions, or expectations expressed in this website, and past performance of securities prices should not be used as a guide to their future performance.
Adverse event reporting.
To report adverse event(s), you have the following reporting lines: Notification to your treating physician, notification through the Program call center, and notification via the link https://www.contactazmedical.astrazeneca.com. Following your adverse event reporting, you may provide your consent to be reached by the AstraZeneca Patient Safety team to follow up on your corresponding report.
Product Supply.
While AstraZeneca undertakes to make any commercially reasonable efforts to ensure the continued supply of the products participating in this Program, AstraZeneca hereby represents that it does not secure or warrant their uninterrupted availability. Any circumstances beyond AstraZeneca’s control, such as, but not limited to, supply chain disruptions, regulatory restrictions, or any other unforeseen events, may impact product availability. Consequently, AstraZeneca will not be liable to any Program users or third parties for any inconvenience, damages, or losses arising from the temporary or permanent unavailability of such products. In the event of any supply issues, AstraZeneca will communicate the relevant information through official electronic channels.
Indemnity
As a Program Participant you hereby agree to defend and hold harmless AstraZeneca, its Affiliates, Subsidiaries, directors, employees, and agents from and against any and all claims, losses, damages, costs, and expenses (including, but not limited to, reasonable attorneys’ fees) arising from or related to your use of the Program or any violation of these Terms and Conditions. In other words, you agree to be liable for and bear any damages or expenses that may arise against AstraZeneca as a result of any wrongdoing while using this Program. The foregoing means that if any third party makes any claim or complaints of any kind (judicial or administrative) against AstraZeneca due to something you did (or failed to do) in connection with the Program, you will be held accountable accordingly.
This indemnity will apply in full, except where such claims, losses, or damages result directly from willful misconduct or gross negligence on the part of AstraZeneca. In any event the indemnity obligation detailed herein will remain in effect following the end of your enrollment in this Program.
Limitation of Liability
Under no circumstance will AstraZeneca, its Affiliates, Subsidiaries, directors, employees, agents and affiliates be liable for any indirect, incidental, special, punitive or consequential damages resulting from the use, inability to use or performance of the Program, even if AstraZeneca has been advised of the possibility of such damages. This limitation of liability will apply to the fullest extent permitted by law, including, but not limited to, lost profits, business interruption, lost programs or data on the user’s information systems. The user hereby acknowledges and accepts that the use of the Program is at his or her own risk.
Changes or modifications to Terms and Conditions
AstraZeneca reserves the right to modify, change, or update these Terms and Conditions from time to time and at its sole discretion. Such modifications, changes, or updates will become effective immediately upon publication and notification to Program participants through the appropriate communication channels, including, but not limited to, electronic notices and postings on the Program’s official website. The participants must review the current version of the Terms and Conditions on a regular basis. Your continued use of the Program will constitute your acceptance of any modifications made thereto.
Force Majeure
AstraZeneca will not be deemed to be in breach of its obligations under the Program, nor liable for any delay in performance or inability to perform any of its obligations hereunder due to events beyond its reasonable control, including, but not limited to, acts of God, war, riots, natural disasters, fires, pandemics, government restrictions, supply disruptions or any other extraordinary or catastrophic event that prevents AstraZeneca from fulfilling its obligations. In such cases, AstraZeneca will make all reasonable efforts to mitigate the effects of the force majeure event and resume performance of its obligations as soon as possible.
